2012 snapped subframe

I'm curious if all 12's will be warrantied if this part fails. Say you pick up a left over 12 off the floor and well into 2013 this happens, will Gas Gas warranty the part?
 
I was right behind him when this one let go and can tell you it was not crash related. He wheelied into a 3 foot rock face, rear suspension took most of the impact and and he came down hard on the seat with his a$$ and the sub frame failed. He never even fell over.

When you looked at the failure point you will see that there is a spring molded into that part of the sub frame and it is at that excat point the failure took place on both sides.

This is just a first model year new part failure, happens on all brands. The nice thing on this one is that GAS GAS took care of it instantly.

OK so I stand corrected. I had a few spine jarring hits through the seat, harder than any bottoming by far mainily from linkage impacts, and did not feel anything odd to indicate there was a problem. That failure is in a different place than another one I heard about, which was in the rear. Anyway I hope they mold enough '13 spares for parts stock so your not down waiting for replacements. If they truely know the '12 is weak and a big enough issue to change the design, they should replace the parts for the current '12 bikes before they fail. Injection molded parts are dirt cheap once the mold is paid off, almost all profit. It would be good PR and the right thing to do. JMO.
