Shop was rejetting and seized my engine!!??

Yes I would go and have a look at the piston, bore and rings yourself. I think all it's likely to show is that it's srratched and seized though. Bring a camera. I would worry the shop may do a 'cheap' repair and claim there wasn't much damage done when in reality there was.
 
I have pics from the tear down,

I pulled my quad from the shop after two weeks of them telling me they would diagnose the problem. Not until I was there to pick up the quad did they ever mention they would work with me on any repairs! I pay for parts and them do free labor. This would have been alright in the beginning but now after everyones help I think its their fault! The new repair shop I took it to had it torn down in 1-1/2 hours and called me with a complete diagnosis and repair parts list! :D

I'll include the pics of my piston, rings and cylinder. The crank is doesn't seem to have any damage. They diagnosed the piston was blued and to way to hot! Does everyone on here agree? It seems like a hot sieze and like the previous shop should take care of the bill after all this being their fault. I have a big conscious; Am I being unfair in thinking this!? Again thanks again everyone for your help!

I have not seen a piston that bad since my IT465 melted the rings to the cylinder and piston because it was super lean and hot.

I would tell them they need to pay for the parts at least and you pay for the labour at a good shop.
 
Dealing with Shop/Lawyer..the latest need help!

I still am without a quad now since March 12th. I called a lawyer and he has been working on this the last few weeks. He just got a reply from the wonderful shop that siezed my engine and this is what they said:

They are saying my quad siezed under a testing run/load and not during deceleration. They would provide this in court and fight me rather than pay for repairs at another shop. Is this valid? In my opinion it didnt matter if the cylinder got hot from several pulls whether on acceleration or not it would sieze?! Is this true? I really need to know if I have reason to take them to court and can provide evidence that they screwed up!?


I never signed a waiver so should I take them to court? Anyone have suggestions or imput about my case? Thanks again!
 
Another thing..the shop will only warranty work

for 30 days after fixing it. Is this descent? I think it will take me that long to break it back in! Ultimately they said they will repair the quad for free labor, and pay to have my head re-nickolsiled. I will have to pay for the piston kit.
So now I'm out 210.00 for another shops diagnosis and now a piston kit. :confused:

Lawyer says I need a witness now that can testify about what they did wrong if we went to court.

You could have researched how to do a top end and done it yourself with far less effort that you have into this debacle. I f I were you I would have them pay for a plating and see if you can get them to buy you a piston kit. Take the thing home and slap it together. A lawsuit sounds like a total PIA plus when its over your quad still won't run. Learn to work on yur toys yourself, its gratifying and when something goes wrong you will know exactly who to blame. Just my thoughts.
 
Since my quad was under load during sieze,

The shop is saying because they were on the throttle when the quad siezed
Their not liable for the seizure!? Does this make sense!?I have video posted and a link on you tube of their dyno technique on here. I got the impression they were at fault. Am I incorrect?

They are incriminating themselves. The video show NO air flow while they were on the throttle.
The motor ran hot and siezed.

You are lucky to have the video. Any jury watching that will see what actually happened.

Thank you for your imput. Just to reiterate and so I get a warm fuzzy feeling about this all. The shop claims that they are not liable for this seizure. I have video showing their dyno technique which produced alot of critism and replies regarding their incorrect procedure. ( their not using a brake on the dyno drum after a run, lack of sufficient air flow, No clutch on deceleration, and no blipping of the throttle on deceleration to provide lubricate cylinder, no temperature indicator for engine or coolant to provide warning of engine failure ) Can anyone provide a list of proper dyno techniques suggested? Maybe something from Dynojet?
My lawyer talked to the shop owner and he talked about "We will provide proof that we were on the throttle in court when the seizure happened; meaning that they are not at fault" My lawyer not knowing alot about engines and myself too wanted to see if this was a threat of us loosing this case?

In my opinion It doesnt matter after running so many pulls with the above lack of procedures whether on the throttle or not the cylinder was overheaded due to improper procedure and cooling? Can you confirm this is accurate for us to go to court with? I sincerely appreciate your input. Are you a mechanic? I will need have to have some one testify about their lack of proper technique. Can you recommend anyone near Oklahoma? Thanks again, Shane

PS. I never signed a dyno waiver with these guys; isn't tht worth something? My goal is to get them to pay for the repair at another shop and their fighting it like hell. Thanks again, Shane

I'm not sure if it is wise to discuss details of a pending case on an open public forum. I know nothing about lawyers and how they prosecute cases. IMO, I would talk with your lawyer about this thread and your posted video. Is this information still admissable (sp?) in court since you have already presented it publicly? You may already be screwed with no evidence now. :confused:

If no issues, then I would suggest talking to Dynojet directly and ask your questions to them. They are the experts, not any of us here. All you are getting here are opinions which mean nothing in a court of law. Next, I would request if they (Dynojet) are willing to be an expert witness on your behalf. If they decline, your lawyer could have the court request their presence.
